Title: Camera/Photo Question
Post by: BubbleWright on August 12, 2012, 03:40:31 PM
You hand someone your camera to take a photo of you. Is that photo considered to be taken by you because it is taken with your camera?  I ask this question to see if it is ok to post such a photo in the picture thread. ??? ??? ???

I would say it is yours to post, but if you know who assisted, you might offer a thanks. Obviously, if you are in it, you cannot lay claim to have been the photographer. (I'm using "you" in the general sense)

Say I lend you my paint, brush, and canvas so you can do a portrait of me.  Do you claim to be the artist? Of course not.  ;)

The equipment is yours, the results of the image are the person who framed the image and pushed the button.  This is a funny gray area, where dual copyright happens.  Basically you are agreeing to an unspoken agreement.

"Here, please use my equipment to create a unique image, but by returning it to me you waive your rights to it".

Or something to that effect.  :)
